Wrongful death actions are strictly regulated, and only primary beneficiaries such as the spouse, parents and children of the decedent may bring a claim. If no primary beneficiaries exist, a secondary beneficiary may bring a claim, but only if that person was substantially dependent on the decedent.

A survivor action is brought by the personal representative of the deceased to recover for pain and suffering that may have occurred prior to death while the deceased was conscious.

Many times these cases, such as in truck accidents, require bringing in the employer of the negligent party, because the employer would be jointly liable for torts committed by an employee acting within the scope of his or her employment.
